Australian IT Market Web Hosting Terms and Conditions
Australian IT Market will hereby be referred to as “we”, us”, “our”. The customer will be referred to as “customer”, “you”, “I” or “your”.
By setting up any hosting account, the user/customer accepts these Terms & Conditions.
Our services are only made available to individuals and Businesses who can form legally binding contracts. Persons under the age of 18 will not be eligible to purchase any Web Hosting Services from Australian IT Market.
Hosting Accounts will be finalised once payments have cleared and orders have finished processing.
Australian IT Market has the right to cancel any order if fraudulent is suspected.
You may be requested to provide proof of your identity and payment. If paying by credit card, Australian IT Market may ask for you to email a copy of your credit card used to make payment before your account is activated. If this information is not provided, your order and hosting service may be terminated.
It is essential to provide us with an email address which is not associated with the domain you are signing up under.
Website Service and Maintenance
Australian IT Market does not hold any responsibility for maintaining or editing your website and other website files. Your website is entirely your responsibility to maintain and edit.

Primary Account Holder
Only the authorised person listed on the account entered at sign-up will have access to account information and support. This person will be known as the 'Primary Account Holder'. The primary account holder can login to their account for any billing and support access via their login details used to register to the Australian IT Market website.
Cpanel login details will be given to the Primary Account Holder which will differ from the login details originally registered with.
The primary account holder has the responsibility to secure their username and password with any other unauthorised person(s). Australian IT Market will not be held liable for any breeches of your account or any service(s) due to the username and password being distributed.
Australian IT Market may also verify your identity by asking security questions.
The Primary Account Holder may ask for a new set of login credentials.
At times, the primary account holder may provide permission to a secondary user of their choice to access their cpanel. For this, the primary account holder must email Australian IT Marketing with the secondary user's full name and details.
Change of Account Ownership
Australian IT Market does not authorise change of ownerships on any hosting accounts. The Primary Account Holder is entitled to cancel or terminate their account at any time. Refunds for the remaining months left on the contract will not be provided.
Service and Product Payments (Including Billing)
The customer agrees to supply full payment for the services received from Australian IT Market, no later than the due date (which is 10 business days from the initial date of order unless specified). If payment hasn't been received within 10 days of the order date, then a payment reminder email will be sent. If payment hasn't been received within a further 14 days of the order date, then your account may be put on hold or suspended and Australian IT Market may take legal action. You, as the customer, agree that unless you notify us of your desire to cancel any or all services received, those services will be billed on a recurring basis.
Australian IT Market may store Credit Cards Details for recurring payments. We also may ask for your credit card details before or after opening your account.
If you want to cancel your product(s) or service(s) you must open a ticket on our Ticketing System which can be accessed at through your account. Alternatively, you can email [email protected]
All goods and services purchased for which payment has not been received in full, remains the property, internet property and intellectual property of Australian IT Market.
Your product(s) and/or service(s) will not be created/ provided or work performed until funds have been received in full as cleared funds. It is your responsibility to ensure we have received funds by the due date to avoid suspension and/or termination of our products and services.
If account has been suspended due to not paying before the due date, access to the website will not be provided unless paid for the prior and following month.
If you are paying with a credit card that does not have your name on it, you agree that you have obtained the credit card owner’s permission to use the credit card to purchase any service on Australian IT Market, and may be subject to recurring billing.
- Australian IT Market reserve the right to suspend your account if an invoice is outstanding or the payment does not succeed.
- If any Terms & Conditions have been breached, Australian IT Market has the right to suspend your account.
Product and Service Cancellation by Australian IT Market
Australian IT Market also has the right to cancel or suspend your account if we find that you have been engaging in:
• Deceptive, improper or misleading conduct
• Providing false information
• Harassment, abuse or swearing
• Unlawful activities
• Conduct that breaches this agreement
If you wish to terminate your account with Australian IT Market, you must do so by opening a ticket in our Ticketing System via your account or email [email protected].
Australian IT Market will not offer any more service after your account has been cancelled.
Spam or Leeching
Australian IT Marker is against sending unsolicited e-mail, bulk emailing, and spam. We reserve the right to suspend your account and charge if found sending spam.
Publisher and Author of Website(s)
Australian IT Market will not be held liable for nor do we endorse any illegal, offensive, controversial content created or action(s) performed or published on any web site(s) you host or create.
If you are experiencing difficulties with the server your website is hosted on, you are required to notify us of the issue immediately so we can look into resolving it.
All servers are located within Australia. Australian IT Market is purely a reseller. We are not responsible for any server faults or drop outs. We highly recommend keeping a backup of your server. Australian IT Market may not have a backup of your website if it goes down or corrupts.
Backups and Data Loss
Australian IT Market may not always have the latest backup of your server. We highly recommend keeping a backup of your server in your personal space. Tutorials on backing up your server can be provided.
Australian IT Market may have planned server down time, if so, the Primary Account Holder will be notified. On odd occasions, the server may drop in which case the account holder will not be notified.
From time to time, Servers may be upgraded. Australian IT Market does not hold any responsibility if your website breaks or does not work anymore, however support is given to re-initiate website files at a fee.
Australian IT Market prices listed on the website are subject to change at any time, this includes your service. All prices are subject to change without notice, this includes bandwidth excess fees.
If we change the price of a product or service, you as the customer will be re-billed at the updated rate on your next renewal.
Australian IT Market will not be responsible for any damages your business may suffer.
We provide no warranties, express or limited, for the services we provide nor do we guarantee your web site or applications will work error free on our servers.
Australian IT Market reserves the right to revise its terms and policies from time to time without notice. Updates will appear on the company website. By continuing your services you agree to these revisions.

Security & Website/cPanel Compromise
Australian IT Market is not responsible for the website maintenance on your web hosting account. Website maintenance may include, updating of the website CMS, plugins and pages. It is the primary account holder’s responsibility to maintain their own website by updating it or requesting assistance from one of our developers at a fee.
In the unlikely event that your website may be compromised by either hackers, spyware, spam or malware, it is your responsibility to ensure you clean your cPanel account and website to a clean slate. During this time, Australian IT Market may support you with this process at a fee.
Your web hosting service including cPanel may be suspended if a security threat is detected to ensure it is isolated from public access.
